CONSTITUTIONOFTHESTUDENTASSOCIATIONOFTHESTATEUNIVERSITYOFNEWYORKCOLLEGEATOSWEGO(asrevisedonOctober22,1981)ArticleISectionIAlllegislativepowerhereingrantedshallbevestedintheSenateoftheStudentAssociation.SectionII1.TheSenateshallbecomposedofmemberschosenannuallybythelivingcenterorcenters. (The termlivingcentershallbedefinedintheBy-Lawsofthisconstitution.)2.AllSenatorsshallberegularlyenrolledstudentsoftheStateUniversityofNewYorkCollegeatOswegowithanaccumulativegradepointindexofatleastthecollegeminimumforgoodacademicstanding,andeachshallattheendofhiselectionbeamemberofthatlivingcenterandshallremainamemberofthatlivingcenterforthedurationofhis office.3.Senatorsshallbeapportionedamongtheseverallivingcenterswithinthecollegeaccordingtotherespectivenumbersinthelivingcenters. The enumerationshallbemade30-60dayspriortotheAllCampusElection,onthebasisofestimatedmembership. The SenateshalldeterminethenumberofSenatorstobechosenbyeachlivingcenterorgroupoflivingcenters. The numberofSenatorsshallneverexceed66norbelessthan33.Nolivingcentershallbedeniedrepresentation.4.WhenvacanciesoccurintheSenatebyresignationorotherwise,bytheExecutiveAuthoritiesofthelivingcenterorcenters,affected,andeventuallyfilledbyspecialelectionconductedamongtheresidentsofsuchlivingcenters.5.TheVicePresidentoftheStudentAssociationshallbethePresidentoftheSenate,butshallhaveavoteonlyintheeventofatie.6.TheSenateshallchooseitsotherofficers,andalsoaPresidentprotempore,intheabsenceoftheVicePresident,orwhenheshallexercisetheofficeofPresidentoftheStudentAssociation.

7.TheSenateshallhavethesolepowerofimpeachmentandtrialofimpeachments.Inall;casesofimpeachmenttheChiefJusticeoftheSupremeCourtshallpreside,exceptinthecaseofhisownimpeachmentinwhichcasetheVice-PresidentoftheStudentAssociationshallpreside.Nopersonshallbeconvictedwithouttheoccurenceof2/3ofthememberspresent.8.Judgementoncasesofimpeachmentshallnotextendfurtherthantoremovalfromoffice,anddisqualificationtoholdandenjoyanyofficeofhonororturstintheStudentAssociation.SectionIII1.Senatorsmaybeelectedatanopenelectionofthemembersoftheirlivingcenterorlivingcentersgroup.2.TheSenateshallassembleatleastonceeveryfullacademicweekduringthecollegeyear,exceptduringtheweeksofexaminationsandthefirstweekofthefallsemester.3.AllSenatorsshallbeelectedatthetimeoftheAll-CampusElections.SectionIV1.TherecoursetorecallaSenatorshallbeinthehandsoftheconstituenciesfromwhichtheSenatoris tobeconductedinthefollowingmanner:a.SenatorsfromDormitories:20%ofthedormpopulationsmustpetitionforSenatorrecall.Thiswouldrequireareferendumtobeheld,and,if2/3ofthosevotingareinfavorofarecall,theSenatorwillberemovedfromoffice.--CcommuterSenators:20%ofthecommuter pOPUlation[jhO votedinthelastelectionmustpetitionforSenatorrecall.Thiswouldrequireareferendumtobeheld,andif2/3ofthosevotingareinfavorofa theSenatorwillberemovedfromoffice.2.TheSenatemaydeterminetherulesof its proceedings,disiplineitsmembersfordisorderlybehavior,andwiththeconcurrenceof2/3of the'eotal Senate,expelamember.3.TheSenateshallkeepajournalofitsproceeding,andfromtimetotimepublishthesame,andtheyeasandnaysoftheSenateonany question shall,atthedesireof1/5ofthosepresent,beenteredinthejournal.SectionVNoSenatorshall,duringthetimeforwhichhewaschosenhold officeundertheauthorityoftheStudent nopersonholdinganyofficeundertheStudent beamemberoftheSenateduringhiscontinuancein offic::)

SectionVIEverybillwhichshallhavepassedtheSenate,beforeitbecomeslaw,shallbepresentedtothePresidentofthestudentAssociation.Ifheapprovesitheshallsign it; butifhereturnsitwithhisobjectionstotheSenate,theyshallentertheobjectionsinthejournalandproceedtoreconsiderit.Ifaftersuchreconsideration2/3ofthetotalSenateagreestopassthebillitshallbecomelaw.ButinallcasesthevoteoftheSenateshallbedeterminedbyyeas,nays,andthenamesofthepersonsvotingforandagainstthebillshallbeenteredinthejournal.IfanybillisnotreturnedbythePresidentwithin10regular class daysafterithasbeenpresentedtohim,thesameshallbelaw,inlikemannerasifhehassignedit,unlesstheSenatebyitsadjournmentpreventsareturnintheformofavote,inwhichcaseitshallbelaw.SectionVIITheSenateshallbeemposered:1.TosupervisetheAll-CampusElection;2.ToassessaStudentAssociationtax(ThistaxshallbeuniformthroughouttheStudentAssociation.)3.TodeterminetheexpendituresoftheStudentAssociation forthegeneralwelfareoftheStudentAssociation;4.Tohaveauthoritytomakerecommendationsoverallmattersofpolicyaffectingstudentwelfareunderthisconstitution;5.Todeterminethelineofsuccession to theOfficeofStudentAssociationPresidentfollowingtheStudentAssociationVicePresident;6.ToinitiateandenactanylegislationnecessarytoimplementforegoingpowersortofulfillthepurposeofthisconstitutionassetforthinthepreambleexceptwheresuchjurisdictionshallbedeniedbythepoliciesoftheStateUniversityofNewYorkorthestateUniversityofNewYorkCollegeatOswego.SectionVIII1.Nomoneyshallbedrawnformthetreasury,butinconsequenceofappropriationsmadebylaw,andaregularstatement and accountofthereceiptsandexpendituresofall money shallbepublishedfromtimetotime.2.TheSenateshallpassnolawregardingtheinternaloperationofanystudentorganizationrecognizedundertheauthorityoftheofficeof the DeanofStudents.SectionIX1. Upon presentationtotheSenateofaBillandapetitioncontainingthesignaturesof2/3ofthenumberofoncampus and thenumberofoffcampusstudentsrequestlngareferendum,theStudent A550ciation Senateshallthendeterminethevalidityof the;3ignatures withinoneweek. andiftherequired numl,e:c ofsignaturesarefoundvalid,thestudentAssociationSenateshallthenconducttherequestedreferendumwith'27d'lnacaemlCdays.

HowevertheSenateshallnotbeobligatedtoconductthereferendumifthepetitionsarenotvalidated27daysbeforethelastdayofclassesorifthesaidreferendumdoesnotcomplywithStudentAssociationandSUNYguidelines.IfthereferendumispassedbythestudentbodyitshallhavethesamestandingasaBillpassedbytheStudentAssociationPresident.2.TheSenatemay,by2/3voteofthetotalmembership,submitanybilltotheStudentAssociationwhoshallacceptorrejectit;andifacceptedthesaidbillshallhavethesamestandingasanybillpassedbytheSenateandsignedbytheStudentAssociationPresident.ArticleIISectionI1.TheexecutivepowershallbevestedintheStudentAssociationPresident,whoshalltogetherwiththeStudentAssociationVicePresident,beelectedbyanAll-CampusElection.TheAll-CampusElectionshallbeheldattheearliestpracticaldateduringtheperiodfromthe15thofFebruarytothe15thofMarch;andheldofficeforatermofoneyearcommencingthefirstdayofAprilofthesameyearinwhichtheywereelected.2.ThePresidentandVicePresidentshallberegularlyenrolledstudentswithanaccumulativegradepoint index ofatleasttwo-tenthsofapoint(.2)abovethecollegeminimumforgoadacademicstanding,andshallnotbeeligibleforgraduationuntilthecompletionofthesemesterinwhichthetermofofficeends.ThePresidentatthebeginningofthefallsemesterduringhistermofofficeshallbeatleastafirst-semesterjuniorwiththeminimumnumberofcreditstobeconsideredassuch,andtheVice-Presidentshallbeatleastasecond-semestersophomore.3.IntheeventofinabilityofthePresidenttodischargethepowersanddutiesofhisoffice,thesameshalldevolveontheVicePresident.SectionII1.TheStudentAssociationPresident,beforetakingofficeshalltakethefollowingoathofoffice:Idosolemnlyswear(ofaffirm)thatIwillfaithfullyexecutetheofficeofPresidentoftheStudentAssociation,andwilltothebestofmyability,preserve,protect,anddefendtheconstitutionoftheStudentAssociationoftheStateUniversityCollegeofNew York at Oswego.

sectionIIIThedutiesoftheStudentAssociationPresidentshallinclude:1.ThepresentationofalegislativeprogramtotheSenateatthefirstmeetingfollowinghiselectionandatthebeginningofeach 2.Theappointment,withtheconsentoftheSenate,ofalltheofficerswhoseappointmentshallnotbeotherwiseprovided 3.ThepresentationofperiodicmessagesupontheStateoftheStudentAssociationtothe 4.TheexecutionofalllegislationoftheSenateforwhichheshallberesponsibletothe except "..,here aspecificexecutivedepartmentshallbegivenauthority,inwhichcasetheappropriateexecutiveheadshallberesponsibletotheSenate.SectionIVTheStudentAssociationPresidentshallbeempoweredto:1.Requiretheopinioninwritingofthepricipleofficerofanyexecutivedepartmentuponanysubjectrelatingtothe 2.ConvenesuchspecialsessionsoftheSenateasheshalldeem 3.Recommend to theSenatesuchmeasuresasheshalldeemnecessaryand 4.EnterintoagreementswithagenciesandorganizationsoutsidethecollegecommunitybyandwiththeconsentoftheSenateandthepropercollege 5.Representthe Associationpersonally,andthroughhisappointedrepresentatives,inallitsdealingswithagenciesandorganizationsoutsidethecollege 6.AssumesuchotherexecutivepowersasshallnotbedeniedbythepoliciesoftheStateUniversityofNewYorkortheStateUniversityofNewYorkCollegeatOswego,orbythisconstitution.ArticleIIISectionIThejudicialpowershallbevestedinaSupremeCourtandsuchlowercourtsastheSenateshallestablish.ThenumberandmannerofselectionofjusticesoftheSupremeandlowercourtsshallbedeterminedbytheSenateandtheappointmentsoftheJusticesofthelowercourtsshallbeforoneyear.JusticesoftheSupremeCourtshallservefromthetimeoftheirappointmentuntiltheyshallvacatetheirofficebyresignationorotherwise.

SectionIITheSenateshallestablishsuchadministrativeofficesasitshalldeemnecessaryfortheoperationoftheSupremeandlowercourtsandtheSupremeCourtshallappellatejurisdictionoveranylowercourtcreatedbytheSenate.SectionIIIThejUdicialpowershallextend:1.ToallcasestowhichtheStudentAssociationshallbeapartyexceptasotherwisestatedinthefollowingpartsofthis 2.Tothestudentapprovalofalllocalstudentorganization 3.ToanycaseinvolvingtheconstitutionalityofanactorrulingoftheStudentAssociation;4.ToanycaseinvolvingviolationofanactoftheSenateexceptasotherwisestatedinthefollowingpartofthissection:5.Toanydisputebetweenstudents,orbetweenstudentorganizations,ifnolowercourt,housingunitcourt,executivecommitteeorcommission,jUdicialboard,orstandardscommitteeshallhavepriorjurisdiction,inwhichcasethetrialorhearingwasconductedproperlywiththepowertodemandsuchcasesbacktotheoriginaltrialbody;6.And.toanyothercasewherejurisdictionshallnotbedeniedbythepoliciesoftheStateUniversityofNewYorkCollegeatOswego.ArticleIVThisconstitutionmaybeamendedinthefollowingmanner:Uponthesigningofapetitionby2/3ofthenumberofvotersinthepreviousAll-CampusElection,orbya2/3voteofallthe membe;/S/ oftheSenate,anamendmentmaybepresentedtotheStudentAssociationwithintwoweeksafterthepresentationofthepetition,inthecaseofsuchapresentation,tobeacceptedorrejected,andifacceptedshallbevalidtoallintentsandpurposesaspartofthisconstitution.ArticleV1.AllengagementswithorganizationsoragenciesoutsideoforwithinthecollegeshallbeasvalidagainsttheStudentAssociationunderthisconstitution,asundertheAssociatedStudentBodyCouncil.2.Thisconstitution,andthelawsoftheStudentAssociationwhichshallbemadeinpursuancethereof,andalltheauthorityoftheStudentAssociationshallbethesupremelawofstudentlifeatthestateuniversityof New YorkCollegeatOswegoexceptwheretheymayconflictwiththepoliciesorpracticesofthestateuniversityofNewYorkorthe UniversityCollegeatOswego.

3.TheSenatorsbeforementionedandallexecutiveandjudicialofficers,oftheStudentAssociationshallbeboundbyoathoraffirmationtosupportthisconstitution.ArticleVITheratificationofthisconstitutionshallbedeterminedbyatleastaquorumvoteoftheAssociatedStudentBodyCouncil.ArticleVIIThisconstitutionshalltakeeffectimmediatelyandshallbeimplementedbythepresentAssociatedStudentBodyCouncil.

BY-LAWS1.AlivingcentershallbedefinedforthepurposesofSenateapportionmenttooneofthreecategoriesas follows: (a)oncampusresidencehalls,(b)offcampusresidenceunitsrecognizedasresidencehallsbythecollege,and(c) corrrnuters (allstudentsnotresideinginlivingcenterscategorizedbyaorbabove).TheSenateshalldetermineeachyearthegroupingoftheseverallivingcentersforthepurposeofapportionmentandenumerationofSenatorstobeelectedbythesegroupsoflivingcenters.TheseBy-Jawsmaybeamendedbya2/3voteofallthemembersoftheSenate.2.Permanentspeakingseatsshallbe a\varded to:(a)ArepresentativeoftheOfficeoftheDeanofStudents(b)ArepresentativeoftheOfficeoftheCo-ordinatorofStudentActivities(c)TheChiefJusticeoftheSupremeCourt(d)Andtothedelegatedrepresentativeofanyorganization theSenate ahall designatebyamajorityvote.3.Thelegislativesessionshallbeone(1)yearinlengthandshallbeginonthefirstdayinAprilandshallendon the lastdayofMarchofthefollowingyear.4.AllmeetingoftheSenateshallbeconductedbyRobert'sRulesofOrder.S.Civilofficialsshallbe:(a)PresidentandVicePresidentofthestudentAssociation(b)SenatorsoftheStudentAssociation(c)JusticesoftheSupremeandlowerCourts(d)ChairmanandmembersofthevariousdepartmentsandthecommitteesoftheStudentssociationExecutiveandJudicialBranches.6.ASenatororJusticeathisowndiscretionmaychoosetoparticipateinanyofthevariousdepartmentsand cOITmittees oftheExecutiveBranchoftheStudentAssociationforthepurposeofaidinghimindischargingthedutiesofhisoffice.7.TheseBy-Lawsmaybeamendedbya2/3voteofallthemembersintheSenate.AllBy-LawstothisconstitutionshallbesubjuecttointerpretationasbillsundertheprovisionofArticleI,sectionIXofthisconstitution.8.Thisassociationisnotorganizedforprofitnorforthepecuniarygainofitsmembers,officersorotherprivatepersons.Itmaynotissuestockordeclareordistributedividends.Nopartoftheincomeoftheassociationshallenduretothebenefitofanymember,officer,orotherpersonexceptitmaypayareasonablecompensationforservicesrenderedineffectingoneormoreoftheassociation'spurposes, and nomember,officer,orotherpersonshallbeentitledto sh2re inthedis tributioM ofanyof association assets on oftheassociation.Anybalanceofmoneyor assets remainingafterthefullpaymentof association obligationsshallbedirectedexclusivelytothefurtheranceofeduc2tionalpurposes.

9.Uponthedissolutionoftheassociation,themembers,afterpaymentofthejustdebts,obligationsandliabilitiesoftheassociation,willdisposeofallitsassetsbytransfertosuchothernot-for-profitorganization(s)ororganizedandoperatedexclusivelyforeducationalpurposes,orsuchotherpurposesasshallat timequalifyforexemptionunderSection501-C(3)oftheinternalRevenueCodeandSection420oftheNewYorkRealPropertyTaxLawas,in the judgementofthemembers,isbestqualifiedandcompetenttopromotethepurposesoftheassociation.10.Nopartoftheactivitiesoftheassociationshallbecarryingonpropoganda,orparticiaptingin,orinterveningin(includingthepublicationordistiributionofstatements)anypoliticalcampaignonbehalfofariycandidateforpublicoffice.-

I SSOCIATIONPresidentoftheSenateStudentAssociationaffectsmanyaspectsofastudentslife.-Throughournearlyhalfmilliondollarbudget,S.A.funds all cocurricularactivitiesoncampus.Fromhockeygamesto oftheEconomicsClub,theS.A.budgetprovidestheresources fotf'diversesoc$at, recreational,educationalandculturalactivity.Strangelyenough,S.A.suffersfromsomewhatof an identitycr1S1S.Ask astudentwherethe$75.00S.A.feegoes and thereplyisinvariablylimitedto"concerts,theVicePresident'ssalary,andIdon'tknow". 'While concertsandtheVicePresident'ssalaryareimportant(particularlythelatter)thescopeofourfundingismuch morefarreaching.Thisyearweintendtomakethisknown. The themefor1981-82is"TheYearofInvolvement".OurgoalistoincreaseparticipationinS.A.sponsoredclubsandorganizationsby100%.IbelieveS.A.offersmanyexcellentopportunitiesforstudentinvolvement.
